The Ten-Thousand-Pound Loophole
Federal crash testing draws a line at 8,500 pounds. Below it, your vehicle gets a five-star rating and a government-stamped safety report. Above it? Nothing. A Ram 2500 weighs roughly 10,000 pounds and has never been crash-tested by NHTSA. Neither has the F-250 Super Duty, the F-350, or any other Class 2b/3 pickup sold in America. Until this year.
NHTSA just added the Ford F-250 Crew Cab to its MY2026 crash test list.[1] It is the first heavy-duty pickup ever selected for the agency’s 5-Star Safety Ratings program. For 48 years, NCAP tested sedans, crossovers, half-ton pickups, and minivans. The three-quarter-ton truck that outweighs a Civic by 7,000 pounds? Exempt. The legal threshold is 49 CFR § 585.31: FMVSS No. 208 reporting requirements apply to vehicles with a GVWR of 8,500 pounds or less.[2] Above that line, manufacturers can skip dual-airbag mandates and substitute a belt system instead.
FARS tells you what that exemption costs. From 2014 through 2023, heavy-duty pickups (F-250, F-350, Ram 2500) appeared in 3,600 fatal crashes. The truck’s own driver died in 1,226 of them. Everyone else? 2,374 deaths.[3] That is a 2-to-1 kill ratio aimed outward. When an HD truck hits something hard enough that someone dies, the truck driver walks away two-thirds of the time. The other person doesn’t.
Ram 2500 sits at the extreme. Of 748 fatal crashes in the FARS window, the Ram driver died in 153. That is a 20.5% self-death rate, the lowest of any vehicle in the dataset with 200 or more fatal crashes. Flip that number: in 79.5% of Ram 2500 fatal crashes, somebody else absorbed the lethal force. Compare that to a Honda Civic, where the driver dies in 68.1% of its 9,627 fatal crashes. A Civic driver is more than three times as likely to die in their own crash as a Ram 2500 driver is.[3]
This is not an impairment story. HD truck drivers test positive for alcohol or drugs at 19–20%, right at the national average across all vehicle classes.[3] They are not drunk. They are just driving something that the federal government never bothered to test.
Physics is not a mystery. A 10,000-pound truck hitting a 3,000-pound sedan transfers energy according to mass ratios that Newton described in 1687. IIHS has published this math: in a two-vehicle crash, the lighter vehicle’s occupants absorb disproportionately more crash energy.[4] But there is a gap between physics and policy. We regulate the sedan. We crash-test the sedan. We mandate ESC, AEB, and dual front airbags for the sedan. And the truck that kills the sedan’s driver operated for half a century without a single NCAP data point.
The counterargument is real. HD trucks exist to haul 14,000 pounds of payload. Their mass is functional. Mandating Civic-grade crumple zones on an F-350 dually would gut its towing capacity. Many HD trucks voluntarily include stability control, forward-collision warning, and camera systems that exceed the regulatory floor. And the low self-death rate is a feature for the occupant, not a defect. Nobody buying a Super Duty wants less mass.
None of that explains why the truck was never tested. NCAP does not require manufacturers to redesign vehicles. It generates data. It publishes scores. Consumers and fleet buyers use those scores to compare options. For 48 years, an F-250 buyer had zero federal crash test data to reference. Not because the truck was too safe to bother. Because the regulation said “8,500 pounds” in 1978, and nobody updated the number.
NHTSA’s 2026 test list fixes one truck. One model year. One cab configuration. Ram 2500? Still untested. Silverado 2500HD? Still untested. F-350? Still untested. That 8,500-pound exemption still shields every three-quarter-ton and one-ton pickup from the crash test program that was built to protect the people they hit.
Somewhere in those 2,374 other-person deaths, there is a Civic driver who checked the five-star rating before buying. No rating existed for the truck that killed them.
