$4 a Car Would Save 67 Lives a Year. NHTSA Has Been ‘Analyzing Comments’ for 18 Months.

In 1997, Euro NCAP started firing headforms at car hoods to measure what happens to a pedestrian's skull on impact. By 2005, the European Union had codified those tests into binding law, requiring every car sold on the continent to absorb a pedestrian's head strike without exceeding a Head Injury Criterion of 1,000.[1] Energy-absorbing hood liners, deformation space between the hood and engine block, occasionally a pop-up hood that lifts on contact — standard engineering across Europe for two decades running.

On September 19, 2024, NHTSA proposed doing the same for America under FMVSS 228, requiring passenger vehicles under 10,000 pounds to meet pedestrian head-impact standards per Global Technical Regulation 9.[2] Its numbers are staggering. At $2.86 to $4.08 per car, the rule would save an estimated 67 lives annually even after accounting for the pedestrian AEB mandate arriving in 2029, delivering $480 to $593 million in net societal benefit per year at a cost per equivalent life saved of just $1.1 million, less than a tenth of DOT's own $12.5 million value of a statistical life.

NTSB backed it.[3] So did the Center for Auto Safety, calling it "the most significant rule to date in pedestrian crashworthiness." Comments closed December 2024. Since then: "Analyzing Comments." No final rule, no timeline, no deadline.

Meanwhile, 7,148 pedestrians were killed by drivers in 2024, a 57% increase from 2013, with three-quarters dying at night and half struck by SUVs and pickups, the exact categories representing nearly a quarter of American vehicle sales that NHTSA's proposed rule specifically targets.[4]

Now for the detail that should anger you: NHTSA tested a 2003 Dodge Ram and a 2005 Chevrolet Silverado against the proposed head-impact limit, and neither truck exceeded it.[2] Twenty-year-old pickups already pass the proposed standard without modification. FARS shows these two nameplates account for 13,998 total deaths in the federal crash database, with registered fleets exceeding 650,000 each.[5] Vehicles most implicated in pedestrian fatalities can already meet the engineering requirement codified in Brussels two decades ago, yet what they lack is a single law requiring it in Washington.

What this means for you

If your vehicle has a European variant, its hood was likely designed with pedestrian head protection in mind regardless of what American law requires, but if you drive a domestic-only truck or SUV, that design consideration simply does not exist in federal regulation. As a pedestrian, your strongest protection remains avoiding roads without sidewalks after dark, where 65% of pedestrian fatalities occur; check your vehicle for open recalls at nhtsa.gov/recalls.

Limitations

NHTSA's 67-lives-per-year estimate relies on pedestrian AEB projections that could shift under future rulemaking, and FARS does not isolate pedestrian deaths by striking-vehicle model, preventing us from mapping that figure onto model-level rates in the database. Pop-up hood systems face durability concerns; NHTSA's own research found a deployed hood can collapse under a heavy pedestrian's kinetic energy. The 21-year gap between European adoption and American proposal overstates the delay given fleet compositional differences, though NHTSA's analysis accounts for the domestic mix.
