He Googled ‘FSD Not Aggressive Enough.’ Then He Overrode It at 73 in a 30.
Michael Butler was making DoorDash deliveries in Katy, Texas, on the evening of June 19 with Tesla’s Full Self-Driving engaged. Court records show he’d recently Googled “Tesla fsd not aggressive enough 2026,” “FSD is not aggressive enough for city driving,” and “Tesla fsd too timid.”[1] At 8:03 p.m., his 2025 Model 3 blew straight through a residential intersection that required a right turn and plowed into a house at more than 70 mph. Martha Avila, 76, was standing in the front room when the car came through the wall.[2] The speed limit on Rose Hollow Lane is 30.
The NTSB’s preliminary report, released July 15, confirmed what Tesla said within days: Butler “manually overrode FSD (Supervised) by pressing the accelerator pedal to 100%.”[3] No drugs, no alcohol, no seizure. The brakes were never applied in the final minutes before impact, and medical records found no explanation for his claim that he “passed out.”
Tesla’s CEO called this proof that FSD wasn’t at fault: “FSD drives slowly through neighborhood streets and this was a high speed crash!” He’s half right: FSD is conservative in neighborhoods, and that conservatism is exactly what Butler was complaining about in those Google searches. When he floored the accelerator, the driver’s pedal input superseded FSD’s speed commands.[4] No speed limiter kicked in at 30, at 50, at 70, and no AEB resisted the driver’s input. A system classified as SAE Level 2 provided no resistance to a 43-mph overspeed on a street where the road ends at a T-intersection.[5]
This is the aggressiveness feedback loop. FSD’s conservatism frustrates drivers who want to go faster, particularly gig workers with economic incentive to minimize delivery time. They learn the accelerator overrides without triggering a disengagement, and they press harder. The system trains users to defeat it, then offers no guardrail when they do.
The counterargument is strong: Butler caused this crash by flooring a pedal that any licensed driver knows makes the car go faster, in a 30 mph zone, at 44 years old, sober, with no medical condition on file. But since 2016, NHTSA has opened nearly 50 special investigations into Tesla ADAS crashes, identifying about 273 incidents and roughly two dozen deaths.[6] In March 2026, the agency escalated its probe into 3.2 million FSD-equipped Teslas.[7] At some point, “the driver did it” stops being a sufficient answer and starts being a design specification. This is one crash and the NTSB investigation remains preliminary; confirming the feedback loop at scale would require pattern-level evidence. But the architecture that permitted it is in 3.2 million cars.
What this means for you: If you use FSD, know that pressing the accelerator doesn’t trigger a safety disengagement. The car goes exactly as fast as your foot demands while FSD yields control authority to the pedal. If you think FSD is “too timid,” that timidity is the margin between your evening commute and Martha Avila’s living room wall.
