The Federal Door Standard Is Older Than the Moon Landing. NHTSA Just Agreed to Think About Updating It.
Federal Motor Vehicle Safety Standard 206, "Door Locks and Door Retention Components," was written on April 27, 1968.[1] Apollo 11 was still 15 months away. The standard assumed every car had a mechanical door handle. Pull it, the door opens. It has never been updated to address what happens when a car door requires electrical power to operate.
Today NHTSA denied a petition asking it to investigate Tesla Model 3 door releases as a defect.[2] The agency said the petition "did not present evidence of a likely safety-related defect." Instead, NHTSA granted a separate petition to consider whether to issue regulations requiring an emergency door egress system in all motor vehicles. In regulatory English, that is step zero. They have agreed to think about thinking about it.
This matters because electronic door handles are no longer a Tesla quirk. At least 13 automakers now ship vehicles with electronic or flush handles that need power to operate from the outside, and some need it from the inside too.[3] When these cars lose power after a crash, occupants can be trapped. At least 15 people have died in Tesla crashes where the electronic door release failed.[4] First responders have reported being unable to open doors on burning vehicles. FMVSS 206 has nothing to say about any of this because in 1968, the failure mode did not exist.
NHTSA's own recent handling of FMVSS 206 makes the gap more absurd. On June 3, 2026, the agency published a final rule removing "obsolete requirements" from the standard, effective July 6.[5] Three weeks before today's announcement, NHTSA cleaned up a 58-year-old standard by deleting outdated text. It did not add a single word about electronic door releases.
So what happens next? If NHTSA follows its own precedent, the answer is: a lot of nothing, for a very long time. The agency's most recent comparable rulemaking is FMVSS 127, the automatic emergency braking mandate. That NPRM was published in June 2023, finalized in May 2024, and compliance is not required until September 2029.[6] That is six years from proposal to enforcement. The door egress standard has not reached the proposal stage yet. NHTSA is at step zero: agreeing to "gather additional information and data, and solicit public comments, to determine if a rulemaking is appropriate."[2]
Working the timeline conservatively: one to two years for an Advanced Notice of Proposed Rulemaking, another year or two for a formal NPRM, a year to finalize, then three to five years of lead time for manufacturers. That puts the first vehicles required to meet a door egress standard somewhere around 2032 to 2035. The U.S. sells roughly 16 million new vehicles a year. Between now and any compliance date, an estimated 25 to 35 million vehicles with electronic door handles will be sold with no federal standard governing whether occupants can get out after a crash.
The FARS Irony
The vehicles at the center of this are, by the fatality data, among the safest on American roads. Tesla's Model Y carries a FARS death rate of 0.03 per 100 million VMT, the lowest of any vehicle with a fleet above one million.[7] The Model 3 sits at 0.05. A Honda Accord is at 3.07. A Chevy Impala is at 5.00. The cars with the door problem are 60 to 170 times safer per mile than the sedans most Americans actually drive. The post-crash fire egress failure is a catastrophic edge case in vehicles that almost never kill their occupants at all.
That does not make it acceptable. It means the rulemaking gap is hiding behind a denominator. When a Model Y does crash hard enough to lose power and catch fire, the absence of an intuitive mechanical release becomes the entire safety story. Being 60 times safer per mile is cold comfort to the person trapped behind a door that requires a YouTube tutorial to open from the inside.
What To Do
If you drive a vehicle with electronic door handles, find the manual release now. Not after the crash. Not during the fire. Now. In a Tesla Model 3, it is a small pull tab near the base of the door panel. In a Model Y, the rear doors have a different mechanism than the fronts. Your owner's manual has a diagram. Study it. Show your passengers. Tape a label next to it if you have to. FMVSS 206 will not help you, and it will not help you for at least six more years.

Limitations
FARS captures only fatal crashes and does not break out post-crash fire deaths or entrapment as separate categories. The 15-death figure for Tesla electronic door failures comes from Bloomberg reporting, not from a comprehensive federal database. The rulemaking timeline estimate is based on AEB precedent; NHTSA could move faster or slower depending on political pressure and industry lobbying. The "25 to 35 million vehicles" projection assumes roughly linear growth in electronic handle adoption, which could accelerate or plateau depending on market trends and consumer backlash.
Strongest Counterargument
NHTSA is right that this is a design-level issue, not a single-manufacturer defect, and rulemaking is the appropriate tool. A Tesla-specific recall would fix one brand while leaving twelve others untouched. The regulatory approach, though painfully slow, would create a universal standard. The question is whether the pace of that approach is acceptable when people are already dying behind doors that will not open.
