A DA Called a Car Going 142 MPH ‘a Bullet.’ The Physics Says He Was Being Generous.
Ivana Balistreri was twenty-nine. Her daughter Lilliana was two weeks shy of her second birthday, strapped into a child safety seat in the back of a Lexus on Highway 87 in San Jose, stopped in traffic at ten in the morning on a clear December day. Zachary Chernicky’s Tesla was doing 142 miles per hour fifteen seconds before it struck them.[1] At impact, he was still traveling 102, and both vehicles caught fire within seconds. Zack Martins, Ivana’s fiancé and Lilliana’s father, survived the crash, pulled himself out, and tried to reach them through the flames, but the heat had already sealed the doors.
Santa Clara County District Attorney Jeff Rosen filed two counts of murder — not vehicular manslaughter, not negligent homicide, but murder. “The law says that it is murder when someone shoots into a crowd,” Rosen said. “When someone is driving 140 mph, then the driver is the shooter and their car is the bullet.”[1] Deputy DA Marisa McKeown was blunter: “The Tesla didn’t cause this crash. Chernicky did by driving over 140 miles per hour. That kind of speed? It’s not an accident.”[2]
Rosen’s metaphor lands, but it undersells the physics so badly it might actually hurt a jury. A .44 Magnum round carries about 1,945 joules of kinetic energy at the muzzle, enough to kill a person at fifty yards. Chernicky’s Tesla Model 3, at roughly 3,900 pounds and 142 mph, carried approximately 3.56 million joules: not a bullet but 1,832 bullets arriving simultaneously in a single mass of aluminum, steel, and lithium-ion cells, concentrated into a frontal area roughly twelve square feet wide. Even at the moment of impact, after the car had somehow bled off forty miles per hour of speed, it still held 1.84 million joules: the energy equivalent of 946 Magnums stacked in a line and detonated at once.
Compare this to the crash that killed Martha Avila in Katy, Texas, three weeks earlier. Michael Butler, 44, engaged Tesla’s Full Self-Driving, then pressed the accelerator to 100%, and drove his Model 3 at over 70 mph through a residential zone with a 30-mph limit, through an intersection, and into the living room of a 76-year-old woman’s home.[3] Butler got manslaughter. $150,000 bail. His car at 70 mph carried roughly 860,000 joules (442 Magnums, for anyone counting), and it was plenty to kill someone sitting inside a house. NTSB confirmed he overrode FSD by flooring the pedal, which the defense will frame as a deliberate act. Chernicky got murder and no bail. The legal logic is that speed itself, at some threshold nobody has codified, crosses from recklessness into implied malice: you knew this could kill someone, and you did it anyway.
NHTSA’s latest sub-category report puts 2025 speeding deaths at 10,035, an 11% drop from 2024 and the first return to pre-pandemic levels.[4] The agency launched a July enforcement campaign with the tagline “Speeding Catches Up with You.” It catches up, all right: kinetic energy scales with v², which means Chernicky at 142 mph hit with 22.4 times the crash energy of a car doing 30 in the same lane. Not 4.7 times faster. 22.4 times more energy. The difference between a fender bender and a cremation is a polynomial, and it grows faster than any human driver intuits, which is exactly why speed limiters exist in every industrial nation that is not this one.
The EU mandated Intelligent Speed Assistance on all new vehicles starting July 2024. ISA warns the driver, then limits acceleration above the posted limit unless overridden. In the U.S., NHTSA proposed a similar rule in 2023, withdrew it in 2024, and has not reintroduced it. There is no federal law preventing a production car from reaching 142 mph on a public road. Every major automaker builds and markets that capability, then files its hands of responsibility when someone uses it. Chernicky might be a murderer. But the machine he drove was engineered, advertised, and sold to do exactly what the prosecution says killed two people.
The counterargument is real, and it matters. Murder requires implied malice: proof that the defendant subjectively appreciated the mortal risk and chose to ignore it. That is an astronomically higher bar than gross negligence. Defense attorneys will argue that Chernicky, like millions of drivers, sped without specifically contemplating that someone would die. The Rancho Mirage street racing murder conviction, affirmed in Riverside County in 2026, took years to prosecute and turned on specific evidence that both defendants understood the danger.[5] If DAs start charging every extreme-speed crash as murder, they will lose most of those cases, and the losses will make future prosecutions harder. Implied malice is a scalpel, not a billboard, and overuse will dull it.
But 142 mph is not “everyone speeds.” At 142 mph, stopping distance exceeds 900 feet. Reaction time at that velocity covers 310 feet per second — a football field before the brake lights even come on. Every car on the highway becomes a fixed obstacle in a targeting range that the driver cannot possibly clear. If that is not conscious disregard for human life, it is difficult to imagine what would be.
Lilliana Balistreri had been alive for 715 days. Her child safety seat, properly installed, rated for rear and side impacts, was designed to protect her in crashes up to approximately 30 mph. Nobody builds a child seat rated for 102.
